These are the Terms of Use on which we provide our Services to you.

This Terms of Use relates to Cohort Solutions Pty Ltd (ABN 63 154 889 139) and any of its subsidiaries, including OSHC Australia Pty Ltd (ABN 55 161 290 884).

Glossary.

In this Agreement, the following definitions shall apply:

  1. “Website Terms”, “Terms and Conditions” and “General Terms” shall mean Terms of Use.
  2. “Agreement” shall mean Customer Agreement.
  3. "The Company”, “Cohort Go”, “We”, “Us” or “Our” shall mean Cohort Solutions Pty Ltd (ABN 63 154 889 139) whose registered office is situated at Suite 19, 115 Wickham Street, Fortitude Valley, Queensland, 4006 Australia.
  4. “OSHC Australia”, “OSHC” and “Student Health Insurance” shall mean OSHC Australia Pty Ltd (ABN 55 161 290 884).
  5. “Customer”, “You” shall mean the person or organisation named as being the Customer.
  6. “Services”, “Modules”, “Features” and “Platform” shall mean all products, services, technologies and functions offered by Us.
  7. “The Website” shall mean www.cohortgo.com and any of its subsidiaries including www.oshcaustralia.com.au and all previous company websites such as www.cohortpay.com, www.cohortarrivals.com and www.cohortflow.com.
  8. “Linked Sites” shall mean links to third-party websites and resources.

This Website and some of its contents are protected by various intellectual property laws, including copyrights, trademarks, patents, and other proprietary rights. You agree not to use this intellectual property in any way and to comply with all intellectual property laws. This applies, not only to the intellectual property of Cohort Solutions Pty Ltd, but also to the intellectual property of other companies whose business names and logos may be displayed on this website. The copyright for the content on this Website is owned or licensed by Us and is protected under the Copyright Act 1968 (Cth) and by other copyright laws in both Australia and other countries. No material on this Website may be reproduced, adapted, uploaded to a third party, linked to, framed, performed in public, distributed or transmitted in any form by any process without Our specific written consent. All custom graphics, icons, and other items that appear on the Website and all associated trademarks, are trademarks of Ours.
  2. Your access/use implies agreement. The Website is available for your use only on condition that you agree to these Terms of Use. You agree that any use by you of the Website, or acceptance of Cohort Go products or services, shall constitute your acceptance of the Terms of Use. It is important that you read these terms in detail and make sure that you understand it fully before using this Website or accepting any of Our products or services.
  3. Modifications to the information. We do not warrant the accuracy, adequacy or completeness of material on this Website. All information may be changed, supplemented, deleted or updated without notice at Our sole discretion.
  4. Modification to the Terms of Use. We may revise and update these Terms of Use at any time. Your continued usage of the Website after any changes to these Terms of Use will mean you accept those changes.
  5. Errors and problems. We do not guarantee or warrant that the Website will be free of infection or viruses, worms, Trojan horses or other code that manifests contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining an appropriate means for the reconstruction of any lost data.
  6. Outbound Links. The Website may contain links to third-party websites and resources (“Linked Sites”). These Linked Sites are provided solely as a convenience to you and not as an endorsement by Us. We make no representations or warranties regarding the availability, correctness, accuracy, performance or quality of the linked site or any content, software, service or application found at any linked site.
  7. Inbound Links. We generally encourage and agree to your linking to the home page through a plain text link on your website without the need for agreement between yourself and Us. However, linking to any other page of the Website is strictly prohibited, without express written permission from Us.
  8. Jurisdiction. This Website shall be governed by and construed in accordance with the law in effect in the State of Queensland, Australia and by using this Website you agree to the jurisdiction of the courts of the State of Queensland, Australia in relation to any dispute.
  9. Disclaimer of Warranties. We make no representations or warranties about the accuracy, completeness, security or timeliness of the content, information or services provided by the Website and disclaim all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties' rights, and fitness for a particular purpose.
  10. Indemnity. You agree to indemnify us for any claim made by any third party due to or arising out of your use of this website or by accepting any of our products or services.
  11. Statements of the Law. Statements made on the Website are not intended to be statements of the law.

Limitation of Liability.

If We are found responsible for any damages, We are responsible for actual damages only. In no event shall We be liable for any incidental, indirect, exemplary, punitive and/or consequential damages, lost profits, or damages resulting from lost data or business interruption resulting from the use of or inability to use the Website.

To the maximum extent permitted by law, we exclude all liability and responsibility to you in contract, tort (including negligence), or otherwise, for any loss or damage resulting, directly or indirectly, from any use of, or reliance on, this Website or by accepting any of our products or services.

When determining if we have caused you to suffer loss, you accept the actions of intermediaries not employed by us are the actions of third parties. We will not be responsible for any loss caused by a third party.

If you suffer loss or damage as a result of our negligence or failure to comply with this Agreement, any claim by you against us arising from our negligence or failure will be limited in respect of any one incident, or series of connected incidents, to a maximum of A$100 upon written evidence of your loss, providing your payment was made with sufficient time.

Partners.

In order to reduce the cost to you, we work with banking, health insurance, accommodation and other partners to reduce the cost of your educational expenses abroad.

Disclosure of Commissions.

We may receive payments and/or commissions from service providers in order to provide the services on this Website.

Electronic Communication.

You agree that we can communicate with you electronically either by email or by website notices. We may from time to time contact you by phone.

Reviews.

You agree that any review submitted to Cohort Go, shall constitute your acceptance of the Terms of Use.

By submitting content to any Cohort Go review site, you understand and acknowledge that this information is available to the public and as such, is considered a public record and that you are allowing Cohort Go, and any of its subsidiaries, to have a permanent right to use your comments for business purposes including but not limited to internal and external promotions. This could include using, republishing, reproducing, distributing, changing or displaying the comments across Cohort Go services and other websites without restriction from time of submission in perpetuity.

We may edit and publish edited or partial versions of the review. We will never edit your review in such a way as to create misleading impressions of your views. Cohort Go reserves the sole right to review, edit and/or delete any reviews it deems are inappropriate.

Rewards.

  1. Agreement. By accepting a reward from Cohort Go you agree to the Cohort Go Terms of Use. Enquiries regarding any aspect of Cohort Go rewards can be directed to support@cohortgo.com.
  2. GiftPay Rewards. If you are rewarded with a GiftPay e-gift card, you can select from a range of merchant-issued electronic gift cards and vouchers via the unique link sent to you from Cohort Go. These gift cards and vouchers are issued by the relevant merchant and are subject to that merchant's terms, conditions of redemption and expiry dates. GiftPay e-gift cards have an expiry date. If the recipient of an eGift has not redeemed their eGift before the expiry date, the value of that eGift is forfeited.
  3. Invite a friend campaign reward. To be eligible for the invite reward, your friend(s) first transaction must be to the value of $1000 AUD or more and completed via the unique payment link sent in your invitation email. Each friend can only be invited once. Your reward will be emailed to you within 1-week of a successful referral.
  4. Student review beta campaign reward. This campaign is strictly limited and applies to reviews made during the relevant campaign period, commencing March 2018 and expiring 11:59pm (AEST) on 30 April 2018. Your reward will be emailed to you once the feedback survey has been completed and your review is live.
  5. Modification or termination. We reserve the right to modify or remove the rewards program at any time or refuse a reward if we suspect any dishonest activity (for example, by inviting yourself, fictitious people, or already existing users).

Promotions.

Promotions are strictly limited, and applies to orders placed during the relevant promotional period, expiring 11:59pm (AEST) on the day specified in the promotion.

  • Promotion codes will be specified, relating to each promotional offer and period.
  • Promotion codes must be quoted on purchase orders submitted to Cohort Go.
  • Promotional offers can only be redeemed once per billing authority for each promotional period.
  • Promotional offers will not be valid for contracted or discounted prices.
  • Any credit earned through promotions will expire six months after the order has been processed by Cohort Go.
  • Discounts will be applied on GST exclusive prices where applicable.

Customer Agreement.

Condition of Sale.

The following Conditions of Sale shall apply to any Cohort Go product or service sold on this Website. These Conditions of Sale constitute a complete and exclusive statement of the agreement and understanding between You and Us with respect to the subject matter hereof.

These Conditions of Sale may change from time to time and you are required within reason to revisit these before placing your order to ensure that these Conditions of Sale have not changed.

  1. Agreement. This Agreement is a contract between you and Cohort Solutions Pty Ltd (ABN 63 154 889 139) for the use of any products or services that we make available to the Customer.
  2. Binding Agreement. You agree that any use by you of the Website, or acceptance of any other product or service provided by Cohort Go, shall constitute your acceptance of the Agreement. It is important that you read this Agreement in detail and make sure that you understand it fully before using this website or accepting any of our products or services. Should you not accept any of the terms of this Agreement, you should not register on the website or otherwise use the website.
  3. Eligibility. The products available on the Website for sale under these Conditions of Sale are only available for sale to individuals who can make legally binding contracts. The products are not available to persons under the age of 18 years nor any other person legally prohibited from entering into a binding contract. By placing your order, you are verifying to Us that you are able to make a legally binding contract. We reserve the right to refuse to accept any new user or any transaction at our discretion. We may also, at our discretion, exclude you from using the service without notice and for whatever reason.
  4. Your Offer. Your order is an offer by you to purchase a particular product for the price (including, where appropriate, the delivery and other charges and taxes) specified on the Website at the time of offer and shall be understood to be placed under these Conditions of Sale.
  5. Acceptance. We reserve the right to accept or reject your offer for any reason, including, without limitation, an error in the product description or the price posted on the Website, the availability of the product, or an error in your order. Your contract with Us only comes into existence when We forward you an email containing confirmation of receipt of your order, an acceptance of your order and confirmation of receipt of your payment.
  6. Product Details and Pricing. Unless otherwise indicated, all products are quoted in Australian dollars (AUD). The amounts quoted on the Website are subject to change at any time. Whilst we have procedures in place and we endeavour to keep all product details on the Website current, to the maximum extent permitted by law, we do not guarantee the timeliness, accuracy or completeness of product or pricing information on the Website.
  7. Third Party Beneficiaries. Our suppliers and related entities are entitled to rely on, and enforce these Conditions of Sale as if they were a party to them.
  8. Governing Law. These Conditions of Sale shall be governed by and construed in accordance with the law in effect in the State of Queensland, Australia and both parties accept the jurisdiction of the courts of the State of Queensland, Australia in relation to any dispute between them.
  9. Risk and Liability. You assume all risks and liabilities for consequences arising from the use of the goods or services whether singly or in combination with other goods or services and indemnify Us in respect of any such use.

Specific Terms.

Cohort Go Payments.
  1. Eligible Transactions. You are only permitted to use this service to make payments for:
    • Tuition and other international education related fees, to officially approved Education Institutions that offer courses to people studying on student visas;
    • Cohort Go partners including accommodation and overseas student health insurance providers; and
    • Where available, your own bank account.
  2. Authorisation. By accepting this Agreement you authorise Cohort Go to make payments on your behalf. Cohort Go will make the payment on your behalf according to the details that you have provided us.
  3. Payment. It is your responsibility to ensure that the details of the transaction are accurate. Once you confirm the transaction, We immediately hedge the currency risk to ensure that we are not exposed to market moves in the exchange rate. Therefore, we cannot cancel any payments.

    For every transaction you enter with Us, you agree to complete the transaction as detailed in your personalised confirmation. This includes paying the foreign currency amount into our bank account by the settlement date. This can generally be completed by instigating a telegraphic transfer (wire) by you (or someone acting on your behalf) physically entering your branch of your bank or using your bank's internet banking portal. Where available, you can make payment into a Cohort Go local bank account.

    It is your responsibility to ensure that the payment is processed into Our bank account and does not fail or remain unprocessed for any reason. If you have followed the instructions on the confirmation, but your bank suggests there is a problem with the payment, please contact Us.

    Once your funds reach Our bank account in the amount you have transacted, providing the information provided to Us is correct, you have fulfilled your obligations. We then assume your liability to pay your institution according to the details that you have provided us.
  4. Refunds. Once payment has been received by Us, no refunds are permitted. Any refund you may be entitled to must be requested directly from your provider abroad according to the rules of cancellation and repayment of this provider.
  5. Fees. We do not charge any fees for using our international tuition payment service. You are liable for any fees that your bank may charge you from time to time. This includes any fees that may be charged to you for whatever reason. Should any fees you are charged reduce the foreign currency amount that We receive into Our bank account, you agree to either instigate a further payment into Our bank account or contact Us to organise to pay the remaining funds in AUD into Our AUD bank account. We will not make payment until We have received payment in full.
  6. Website claims. Savings mentioned on the Cohort Go website are based on the assumption of savings of 3.5% based on investigations by Cohort Solutions Pty Ltd of average retail margins and fees for foreign currency transactions. Individual rates and savings may vary.
  7. Timing. While we take every care to ensure the payment is expedited, you should ensure that you instigate a transaction in a timely manner leave sufficient time for your payment to be processed.
  8. Closure of FX Markets. When FX markets are closed, we may temporarily suspend the payment service.
  9. Erroneous Pricing. We rely on third party vendors to provide us with real-time pricing on currency exchange rates. Should any of these rates be manifestly incorrect, we will contact you as soon as possible to let you know of the error and the correct payment amount. You can either proceed with this correct payment amount or cancel the transaction. We will not be held liable for any incorrect rate feeds.
Cohort Go Student and Agent Management.
  1. Refunds. Once We have confirmed your payment, your purchase of the monthly subscription is final and not refundable.
Cohort Go Arrival Services.
  1. Identification. You may be required to provide a credit card at check-in/arrival to cover incidental charges and you may also be required to provide photographic identification. Suppliers may refuse accommodation where they are not reasonably satisfied as to the credentials of any guest at the time of check-in/arrival.
  2. Changes, cancellations and refunds. Terms and conditions for booking changes, cancellations and refunds are specific to each supplier. These terms are set out on the payment page. To make changes to your booking, or to request a cancellation, please email us at support@cohortgo.com. If you are entitled to a refund under the supplier's terms and conditions, the refund will be made through the system to the same account that you used to pay for the booking.

OSHC Australia.

  1. Purchases. By purchasing and paying for a policy via this Website, you warrant you are the authorised holder of the account used for payment and/or have express consent of the authorised account holder to make the relevant purchase and payment.
  2. Summarised Information. The Website contains statements regarding the terms of the products offered, including details of the benefits available and items not covered by the product. Such statements are generalised in an attempt to give you a summary of the types of products available and not a comprehensive comparison of all terms and conditions of each policy document. Not all products are the same and you should confirm the exact terms of any product that you intend to purchase prior to proceeding. You are responsible for your choice of OSHC insurance and should you have any doubt regarding an OSHC policy, you should seek further advice in order to make a fully informed decision.
  3. Company Status. We are not a registered health benefits organisation, and do not provide any health-related services. We do not guarantee the ability of the provider to fulfil its obligations to provide the insurance that you may purchase.
  4. Refunds. Refunds for your purchase can be facilitated from the provider in the following instances:
    • If your visa was refused by the Department of Immigration and Citizenship (proof from DIAC will be required).
    • You have decided to not travel to Australia.
    • Where you have inadvertently bought two policies from the same or different providers.
    • You have made a mistake in your application.

Where you are entitled to a full refund, we will refund you the full purchase price, less any bank fees that may be charged if we need to send you an international payment. Where you are not entitled to a full refund, we will refund you for the unused portion of your premium, less any bank fees that may be charged if we need to send you an international payment and any minimum cover period or refund processing fee that your provider may charge.
